Advice & Counseling

Employers of all sizes need to make informed decisions based on a comprehensive understanding of the state and federal laws applicable to their workforce. We provide advice and counseling to help our clients understand and comply with these laws, and we assist our clients with implementing solutions that effectively mitigate their employment-related risk while at the same time giving due respect to business goals and fostering a comfortable and productive work environment.

Drafting & Review of Contracts/Policies

The employment relationship is, at is core, contractual.  Often no formalization of that relationship is needed, but at other times a formal written contract is needed to memorialize a specific agreement.  Our lawyers draft, review, and negotiate all types of employment-related agreements, from executive compensation contracts to confidentiality/non-disclosure agreements and restrictive covenants including non-competes and non-solicits. We also assist employers with developing, updating and implementing fully-compliant and comprehensive employment policies and procedures. We draft policies that address all relevant requirements under all pertinent state and federal laws, and we give our clients the advice and resources they need to promote compliance throughout their workforce.

Audits & Investigations

We represent employers in internal and external audits and investigations. Employers must periodically audit their employment law compliance efforts to ensure compliance, and they must investigate promptly when employees complain of harassment, discrimination, retaliation, and work-related injuries. When facing external inquiries conducted by authorities such as the U.S. Department of Labor, Occupational Safety and Health Administration (OSHA) and the Equal Employment Opportunity Commission (EEOC), employers must respond promptly, and must ensure they have the information and insights they need to defend themselves effectively.

Litigation

At Stembridge Taylor, we represent both employers and employees in all types of employment-related litigation, from discrimination to wage and hour to leave-law issues and contract disputes, and everything in between. Although much of our work is dedicated to risk-minimization and litigation avoidance, sometimes litigation is the best or only solution, at least temporarily.  We are highly skilled litigators and represent our clients zealously in all phases of litigation, from pre-suit negotiations all the way through trial and appeal.   We litigate in both state and federal courts and also have significant experience in mediation and arbitration.  While we are always prepared to litigate to a final resolution when necessary, we are adept finding creative paths to efficient and favorable resolution of our clients’ disputes without the necessity of protracted litigation.
